The American media won't be able to escape what has happened, because people are going to start asking questions. The Americans are in distress. They are afraid by what's happening in Iraq. The support for the government is the lowest yet. They have the world's worst incarceration rate. They suffer terribly under the hand of their government. By burning the American flag, we are disrespecting the American people, many thousands who are dead because of the evil government whom the American people do not want. Consider the fact that no marijuana smokers with records can vote - and many thousands of others who were "not eligible" for whatever racial/criminal/voting fraud reasons - it's clear that a huge majority of American citizens were strippped of their voting rights, and therefore, more people disapproved of Bush than even what the polls can say. The Americans need help. They are as desperate as any nation under the rule of an evil dictatorship. Now, an upside down flag means "country in distress". America is in serious distress. America is not exclusively the government. Even though the government has stolen the flag and twisted what it respresents, the American people love their flag, like we do ours. They respect it. And so should we. That's why we should use upside down flags (with messages of distress) if we want to include the American flag as a symbol in our upcoming struggle. I know Canada could never aid a country that would burn our flag for our attention. ------------------------------ Date: Sun, 7 Aug 2005 00:20:43 -0700 From: Steve Kubby Subject: 002 "DON'T BURN THE US FLAG, HANG IT UPSIDE DOWN INSTEAD: THEY ARE IN DISTRESS" MARC EMERY: DON'T BURN THE US FLAG, HANG IT UPSIDE DOWN INSTEAD: THEY ARE IN DISTRESS We want to help the American people, and we need them to help us as well. Interviews have kept me busy, but I'm proud of all who have responded to this crisis/opportunity with donations, letters to the editor, contacts with politicians and other methods of girding up for the great effort to end marijuana prohibition. I hope you, my loyal friends and soldiers in our struggle, are satisfied that I have conveyed the correct values of our struggle and that I am leader you are proud of, and to whom you can say is shoulder to shoulder with you in our great liberation movement. I have been out of the jails for 27 hours now and will certainly post more in the days ahead. Please understand that this very real possibility of me spending my entire life in maximum security federal prison in the United States is a tremendous opportunity to galvanize both Canadians' and Americans' understanding that tens of thousands of Americans are already in federal prisons throughout American for nothing more than growing our beloved and sacred cannabis. 5, 10, 15, 55 year sentences. My wonderful friend Mike Smith, last March, was sentenced to 30 years in an Oklahoma prison for growing 200 plants! Something that the BC Court of Appeal ruled only last week should not necessarily exceed a conditional sentence of house arrest or fine when it reduced a 2 year sentence for a defendent who had 200 plants down to a conditional discharge! That brings us the the underlying politics of this arrest. No one complained to the Vancouver Police about me in 7 years! I had NDP leader Jack Layton in my home, on was well acquainted with the Mayor, most members of Council, knew Senators and MPs, was completely transparent & open about everything I ever did, including the Canada Revenue Agency, which took my $400,000+ income tax payments (from the sale of marijuana seeds it was always explicitly understood, I personally had no other income ever) from 2000 - 2005, which then gave it to the BC Provincial government and the Canadsian federal government. The leading and often exclusive voice for PROHIBITION in Canada are its police agencies, as everyone here who follows the testimony in Senate & Parliamentary Committees, TV debates about prohibition, etc. is aware. They are losing the battle for the heart and soul of the Canadian citizen and voter. The voters and people are not buying prohibition. Support for legalization since I became prominent in 1994 has doubled for 26% to 57% today. They have been losing, and losing fast. The Vancouver Police, the BC solicitor-General, other top cops and Police Association reps in Canada continually call for "longer sentences", a US style drug war, and more pain, punishement and prisons. The cry for bigger budgets, more military technology. But Canadian police are in envy of their American brothers sheer firepower and ability to rapidly escalate the decay and torture and intimidation of a full scale drug war. So eliminating me accomplishes, so they think, their mission, to stop this changing politrical landscape. Both the Canadian police and the DEA think that by eliminating me, they have eliminated the enemy's main supply & intellectual footing. Canadian police have always been unhappy that courts will not send me to jail for seeds. They are unhappy the last two Mayors of Vancouver have called for legalization. One of them, former Mayor Philip Owen, was a very vocal prohibitionist who worked to eliminate me from the scene when VPD conducted the four raids against me from 1996-1998. He converted and now is an articulate spokesman against prohibition. The Vancouver Police are unhappy national leaders like Jack Layton came to my home and appealed for support. So they knew they would not get satisfaction under Canadian law with Canadian courts and Canadian media, so they surely encouraged the DEA to help them accomplish what Canadian law and Canadian judges and the Canadian public would not do. The police engaged in treason. The VPD has invited the DEA onto Vancouver soil to facilitate what the Canadian establishment (the law, courts, media, & citizens) would not do, punish me severly. The VPD action is a calculated and deliberate subversion of everything Canadian in order to achieve an extra-judicial punishment (life imprisonment) to satisfy the political agenda of the Canadian police organizations. They could not achieve this result in any other way but to invite the US government in to secure a 'sentence' the VPD wants, that it cannot achieve through any Canadian institution. The issues here are: Canadian sovereignty. The Vancouver Police must swear a loyalty oath, yet this clearly establishes that the VPD is not willing to abide by Canadian courts, is not willing to acknowledge Canadian law as supreme, nor can they even say they are to loyal any precept that is Canadian. Now anyone who sells a gram of pot to an American on the street, who is then foolish enough to take it over the border, can be extradited with 'conspiracy' if the police don't feel a Canadian court will adequately puinish that person. Tens of thousands of people who sell pot retail, wholesale, or in any way to an American who gets caught with it is now in some way in a 'conspiracy' to send pot to the USA and if the VPD or ANY Canadian police force want you to experience long punishments that they cannot get in a Canadian court, these extraditions will become much more prolific. Punishments in Canada and the USA for say, 100 plants, are radically disproportionate. For 100 plants, in BC, it a certainty there would be no jail, in Manitoba, up to 6 months, in Saskatchewan, up to 18 months, maybe at most. In the USA, 100 plants can bring years in jail, sometimes 5 or 10 years or three-strikes, up to 25 years. Police are constantly expressing frustration with Canadian court sentences and are now extra-judicially making their first big move to do something about it, send problem 'offenders' to US justice. ------------------------------ Date: Wed, 31 Aug 2005 20:33:25 -0700 From: Steve Kubby Subject: 004 =?WINDOWS-1252?Q?Canada_Concedes_Kubby_Removal_=93Not_Imminent?= =?WINDOWS-1252?Q?=94_As_Evidence_Mounts_of_Fraud_by_California_J?= =?WINDOWS-1252?Q?udges?= For Release: Thursday, September 1, 2005 Contact: Michele Kubby (250) 578-8422 Attorney Bill McPike (559) 841-3366 CANADIAN IMMIGRATION CONCEDES KUBBY REMOVAL FROM CANADA =93NOT IMMINENT=94= AS EVIDENCE MOUNTS OF FRAUD BY CALIFORNIA JUDGES. In response to a complaint filed by Michele Kubby, Immigration Canada =20= has said that the removal of her husband, cancer patient Steve Kubby, =20= from Canada is =93not imminent.=94 This statement by Immigration Canada contradicts numerous reports in =20 July in the Canadian and American media that Kubby had =93lost his =20 battle to stay in Canada.=94 Although the Kubbys remain under a =93removal order=94, as they have = been =20 for the last two years, Immigration Canadahas acknowledged that the =20 order is currently stayed while the Kubbys file a =93pre-removal risk =20= assessment=94 (PRRA) application. In the event that the PRRA is rejected, the Kubbys will then have the =20= right to file for Leave and Judicial review and further stay of the =20 removal order pending final resolution. Steve Kubby, whose life depends on having large quantities of =20 cannabis to control a rare but usually fatal form of adrenal cancer, =20 said that he was reminded of Mark Twain=92s famous line about the =20 reports of his death being =93greatly exaggerated.=94 In the event that the PRRA is rejected, the Kubbys will then have the =20= right to file for Leave and Judicial Review and further stay of the =20 removal order pending final resolution. Steve Kubby, whose life depends on having large quantities of =20 cannabis to control a rare but usually fatal form of adrenal cancer, =20 said that he was reminded of Mark Twain=92s famous line about the =20 reports of his death being =93greatly exaggerated.=94 =93I am fighting for my life, and we are having to wage this battle on =20= two fronts, here in Canada and also in California. We were concerned =20 that the Canadian government was trying to rush us out while the =20 courts in California stall investigation of criminal malfeasance by =20 two or more California judges,=94 Kubby explained. Investigative journalist Pat McCartney, who started reporting on the =20 Kubby case in 1999, has documented evidence that at least two =20 California judges violated several state laws by signing orders that =20 the Peoples appeal for having a tiny amount of =93mescaline=94 was to be = =20 treated as a felony conviction appeal. First, Kubby had been convicted of a misdemeanor and state law =20 specifically prohibits the conversion of misdemeanors into felonies =20 in the appeal process. It was the claim by California law enforcement =20= that Kubby is a =93felony fugitive=94 that would have made Kubby =20 ineligible for entry into Canada. Second, to make matters much worse, both of the judges in question =20 had also recused themselves from the case for cause, and consequently =20= were violating California law by signing such an order. There is also =20= evidence of an ongoing conspiracy by the California courts to cover-=20 up this illegal action. =93My life depends on my being able to stay in Canada, and prove that =20= the government of Canada has also been the victim of a fraud by =20 California law enforcement, prosecutors and judges.. That is why it =20 is so important that we be allowed time to make our case,=94 said Kubby. After the North Tahoe Narcotics Task Force searched the Kubby =20 residence, California authorities charged the couple with 19 felony =20 counts. A jury acquitted Michele Kubby of all charges and voted to =20 acquit Steve Kubby of all marijuana charges, but convicted him of =20 misdemeanor possession of peyote and a piece of psilocybin mushroom =20 stem. The Kubbys say that even the misdemeanor conviction for mescaline is =20 a fraud, since it was extracted by police chemists from some tiny =20 peyote cactus buttons left by a guest. Unlike the U.S., possession =20 of peyote is not a crime in Canada. - ---------------------------------- Evidence that clearly documents the criminal actions of several =20 California judges in the Kubby case are available online: - --Sworn Statement by Diane Carrol, Placer County Superior Appeals =20 Court Clerk: - --Sworn Statement by Judy Boucree, court reporter: - --Sacramento Bee report confirming the recusal of Judge Roeder: =20 - --Auburn Journal report confirming the recusal of Judge Gaddis: =20 - --"Placer County, Still Murderous After All These Years," by Richard =20 Cowan: ------------------------------ End of AMMA-Talk-Digest V5 #8 *****************************
